Estate Administration

Dealing with a loved one’s affairs after their passing can be overwhelming for most. If you’ve recently lost a loved one, relative or friend, and don’t know where to start, at AMJ LAW we can diffuse and explain the process, where to begin, what to expect, and assist you through the probate or estate administration process on a step-by-step basis. In some cases, we may be able to spare you from applying for probate altogether.

At AMJ LAW we can assist with the initial steps of locating a possible Will, gathering information, notifying beneficiaries, communicating with banks and credit unions, dealing with the Land Title Office, and other asset holders as may be necessary.

We have prepared countless probate applications on behalf of our clients, ranging from the most complex to even the simplest of estates. In all cases we work effectively and efficiently on behalf of our clients to ensure that the probate process goes as smoothly as possible. When the time comes, we will also be there to assist in the transfer of assets to beneficiaries, and provide you with advice and guidance all the way.

If you have recently lost a loved one, relative or friend, contact AMJ LAW. We can assist with:

  • Conducting searches for a Will
  • Conducting property searches
  • Preparing and submitting probate applications
  • Attending to transfers of property and other assets

Estate Litigation

At AMJ LAW we have been assisting beneficiaries in understanding and receiving their entitlement to a loved one’s estate for more than 40 years.

Did you know that if you are the spouse or child of a deceased person, you may be entitled to a share of the deceased’s estate, even if he or she has chosen not to leave you anything in his or her Will, or if he or she has not made a Will? The Wills, Estates and Succession Act ("WESA") mandates certain distributions from those who have not made a Will, and for those who have made a Will, WESA requires that a will-maker make adequate provision for his or her spouse and children.

We work effectively and efficiently on behalf of our clients. We can arrange a fee model that fits within our clients’ means. We do our best to avoid court, but if and when necessary, our lawyers are more than comfortable in the court room to ensure our clients receive their fair share.

Contact AMJ LAW if you believe that you may be entitled to a share of an estate.

Employment Law

If you have an issue related to employment, our experienced lawyers can assist you.

These issues could include:

  • wrongful dismissal
  • forced resignation
  • constructive dismissal
  • employment contracts
  • Employment Standards Act compliance
  • employee data handling and protection

Constructive dismissal is a situation where although you are not dismissed, your position has been so fundamentally changed that it is essentially the same as a dismissal. We can also assist you with situations where you are forced to resign and your employer is treating it as a resignation, rather than a proper wrongful dismissal.

There are many factors to consider with regard to the amount of compensation you might be entitled to in a wrongful dismissal case. These include the age of the employee, the position of the employee, the likelihood that the employee will find alternate work and any enticement on the employee to take the position in the first place.
