It is possible to sue for the death of a family member as a result of the wrongful act, negligence, or default of another person.
The wrongful death lawsuit can be brought by an immediate family member, including a child, parent, or spouse, even though that person was not directly involved in the incident which resulted in the wrongful death of their family member.
Damages may include:
- expenses for medical bills
- hospital bills
- funeral costs
- loss of earning contribution of the family member who died
- loss of guidance to a surviving child
